Eligibility Policy

This eligibility policy sets out the eligibility requirements for the Guests and Owners (the “Eligibility Policy”).
Your use of Ruckify RV Services is at all times subject to the Terms of Service, which incorporates this Eligibility Policy. Any terms we use in this Eligibility Policy without defining them have the definitions given to them in the Terms of Service.
Guest Eligibility Requirements
- In order to be eligible to rent a Trailer on Ruckify RV, the Guest must meet all Ruckify RV mandatory requirements on the Site including, but not limited to the following Ruckify RV’s Guest insurance requirements pursuant to the Trailer Protection Policy (unless otherwise agreed upon in writing by Ruckify RV):
- The Guest must be 21 years of age and able to provide a valid driver’s license number from his or her permanent province/state/region of residence.
- If towing the Trailer, the Guest’s towing vehicle must have valid insurance and valid registration. Proof of all three (driver’s license, registration and insurance of the towing vehicle) must be presented at the Scheduled Start Time of the Rental and noted on the Pre-Post Checklist.
- The Guest shall not have any criminal convictions on his or her record in the last ten (10) years. These convictions include, but are not limited to, the following:
- DWI, DUI, implied consent, any drug related violation, or open container violation, manslaughter, negligent homicide, indictable offence involving a motor vehicle and/or RV (including but not limited to hit and run, leaving the scene of an accident, reckless driving, driving/operating while license is suspended/revoked, license suspension for points, license revoked, resisting arrest, or failing to report an accident.
e. The Authorized Guest must have a valid email address and mobile phone for the duration of the Rental.
Guest Eligibility Documentation
Acceptance of an Authorized Guest into the Ruckify RV program shall be in the sole discretion of Ruckify RV. Guests are required to fill out the mandatory information requested in their dashboard under "Member Verification". You only can become a member of Ruckify RV by fully completing all required fields under the Member Verification page. You will not be permitted to rent any trailer of any kind whether towed or stationary without this step being completed and reviewed by Ruckify RV's Trust & Safety Team. Guests are required to notify Ruckify RV of any changes to their eligibility, including and not limited to the status of a driver’s license, tow vehicle insurance and tow vehicle registration or any criminal charges prior to renting a Trailer using the Services and also just prior to taking possession of the Trailer. Failure to notify and gain proper approvals will result in deactivation of the Guest’s Account. In addition, the Guest will be personally liable for all damages and related legal fees as well as any Trailer Insurance Claim pursuant to the Trailer Protection Policy and damages.
Guest Eligibility Continued Monitoring
Ruckify RV may periodically monitor any Authorized Guest’s driving record, credit score, or educational requirements only to the extent necessary and reasonable for the limited purpose to ensure that such Guests continue to qualify for Membership under our Guests’ Eligibility Requirements. In addition, Guest reviews can be triggered by a number of "Source Events." These may include, but are not limited to, the following:
- External notification by the Provincial/State/Region Registry, Insurance Issuers, or other international authority.
- External notification by any Ruckify RV Member or User.
- Internal notification by the Ruckify RV system functionality that we may establish and maintain from time to time and in our sole discretion.
Trailer Owner Eligibility Requirements
For an Owner’s Trailer to be eligible to Rent on the Site, it must meet all of the following requirements set out in the Trailer Protection Policy as well as follows:
- Be well maintained:
- Owners are expected to properly Schedule and Maintain the Trailer using the applicable manufacturer's maintenance schedule as a guide as outlined in the Owner Policy. Trailer Owners may have claims denied if the rented trailer is found to not be road worthy, or claim could have been prevented with regularly scheduled maintenance.
- Age of trailer:
- Special approval by Ruckify RV may be required in order for any trailer older than 25yrs to participate in the marketplace. Trailer owners may have to get a certificate stating that the trailer is roadworthy and in good condition.
- The Trailer must have an Insured Value of no more than $50,000.
- Trailers listed on the site are only covered by Ruckify RV's insurance policy up to an insured value of $50,000.
- The Trailer must have the proper valid insurance, registration, and any Provincial or Federally required licensing or other documentation.
- The following “RV TYPES” are prohibited from being listed on the Ruckify RV Site:
- Truck Campers, Class A, B, and C Motorhomes, all Camper Vans, all Park Models, and all Park Model Trailers.
- All RV’s with a motor.
- Trailers modified in any way that is not endorsed or approved by the manufacture.
Trailer Eligibility Documentation
Ruckify RV may require additional documentation necessary to establish Trailer eligibility prior to its formal acceptance into the Ruckify RV program. Acceptance of a Trailer into the Ruckify RV program shall be in the sole discretion of Ruckify RV.
Trailer Eligibility Continued Monitoring
Ruckify RV may periodically monitor any records to ensure that a Trailer listed on Ruckify RV continues to qualify for eligibility under our Trailer Eligibility Requirements. In addition, Trailer reviews can be triggered by a number of "Source Events." These events include, but may not be limited to, the following:
- External notification by the Provincial Registry, Insurance Issuers, or other international authority;
- External notification by any Ruckify RV Member or User;
- Internal notification by the Ruckify RV system functionality that we may establish and maintain from time to time and in our sole discretion.
Governing Law and Forum for Disputes
This Eligibility Policy shall be construed, interpreted and enforced in accordance with, and shall be governed by, the laws of the Province of Alberta.
Any matters relating to Insurance pursuant to the Trailer Protection Policy shall be construed, interpreted and enforced in accordance with, and shall be governed by the laws of the Province of Alberta.
All disputes arising out of this Guest Refund Policy shall be referred to binding arbitration in the Province of Alberta as outlined in the “Dispute Resolution” section of the Terms of Service, except where such disputes relate to Insurance pursuant to the Trailer Protection Policy, in which case the jurisdiction will revert to the courts of the Province of Alberta, and where the claim relates to the actual or threatened infringement, misappropriation or violation of a party’s copyrights, trademarks, trade secrets, patents, or other intellectual property rights, in which case the jurisdiction of the courts of the Province of Alberta shall prevail.
